Terms of Service

Welcome to Weeknights. These Terms of Service ("Terms") govern your use of weeknights.nl and host.weeknights.nl (the "Platform"), operated by Weeknights ("we," "us," or "our"). By using our Platform, you agree to these Terms.

1. About Weeknights

Weeknights is a platform that connects people with social clubs and community events in Amsterdam. We provide tools for:

• Attendees: Discovering clubs, browsing events, and purchasing tickets
• Organizers: Creating clubs, managing events, and collecting payments

Weeknights is a platform, not the organizer of events. We facilitate connections between organizers and attendees but are not responsible for the events themselves.

2. Account Registration

To use certain features of the Platform, you must create an account. When you do, you agree to:

• Provide accurate and complete information
• Keep your account credentials secure
• Be responsible for all activity under your account
• Notify us immediately of any unauthorized access

You must be at least 18 years old to create an account and use our Platform.

3. For Attendees

3.1 Booking Events

When you book an event through Weeknights:

• You enter into an agreement directly with the event organizer
• You agree to the organizer's specific terms and event rules
• Your payment is processed securely through Stripe
• You receive a confirmation email with event details

3.2 Refunds and Cancellations

Refund policies are set by individual organizers. Generally:

• Contact the organizer directly for refund requests
• If an organizer cancels an event, you will receive a full refund
• Weeknights may assist in disputes but the organizer has final say on their refund policy

3.3 Conduct at Events

When attending events, you agree to:

• Treat organizers and fellow attendees with respect
• Follow the organizer's rules and instructions
• Not engage in harassment, discrimination, or illegal activity
• Arrive on time and communicate if you cannot attend

4. For Organizers

4.1 Creating Events

As an organizer, you are responsible for:

• Providing accurate event information (date, time, location, description)
• Delivering the experience as described
• Complying with all applicable laws and regulations
• Having appropriate insurance if required for your activities
• Ensuring your venue is safe and suitable for attendees

4.2 Payments and Fees

Weeknights charges platform fees on paid ticket sales:

• Founding clubs: 2.5% platform fee (locked in permanently)
• Standard rate: 5% platform fee
• Free events: No fees

Additionally, Stripe's payment processing fees apply (currently 2.9% + €0.30 per transaction). Payouts are sent directly to your connected Stripe account according to Stripe's payout schedule.

4.3 Cancellations by Organizers

If you need to cancel an event:

• Notify attendees as soon as possible through the Platform
• Process full refunds for all ticket holders
• Repeated cancellations may result in account suspension

4.4 Content Guidelines

Events and clubs listed on Weeknights must not:

• Promote illegal activities
• Contain hateful, discriminatory, or harmful content
• Mislead attendees about the nature of the event
• Infringe on intellectual property rights
• Violate any applicable laws or regulations

We reserve the right to remove content and suspend accounts that violate these guidelines.

5. Payments and Stripe

All payments on Weeknights are processed through Stripe. By using our payment features, you also agree to Stripe's Terms of Service.

Organizers connect their own Stripe accounts to receive payments. Weeknights does not hold funds on behalf of organizers—payments flow directly from attendees to organizers via Stripe, minus applicable fees.

6. Intellectual Property

The Weeknights name, logo, and Platform design are our property. You may not use our branding without permission.

Content you create (event descriptions, club pages, images) remains yours. By posting content on Weeknights, you grant us a license to display and promote it on the Platform.

7. Limitation of Liability

Weeknights is a platform connecting organizers and attendees. We are not responsible for:

• The quality, safety, or legality of events
• The accuracy of event or club information provided by organizers
• Disputes between organizers and attendees
• Any injury, loss, or damage arising from attending events

To the maximum extent permitted by law, Weeknights shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

8. Termination

You may close your account at any time. We may suspend or terminate accounts that:

• Violate these Terms
• Engage in fraudulent activity
• Harm other users or the Platform
• Remain inactive for an extended period

9. Changes to Terms

We may update these Terms from time to time. We'll notify you of significant changes via email or through the Platform. Continued use of Weeknights after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of Amsterdam, the Netherlands.
